1) Eligibility & Acceptance
You must be at least 18 years old and able to form a binding contract to use the Services. By scheduling or authorizing work, you accept these Terms and any policies referenced here, including our Privacy Policy.
2) Estimates, Scheduling & Pricing
- Estimates: Quotes are based on the information and photos you provide and/or our in‑person inspection. Final pricing may change if the scope differs from the initial assessment.
- Scheduling: Appointments are offered on a first‑come basis. We may require a deposit to reserve time or order materials.
- Mobile/Shop Service: Availability may vary by location, weather, power/water access, and safety constraints.
- Taxes/Fees: Applicable taxes and shop or environmental fees may be added where required.
3) Payments
- When due: Payment is due upon completion unless otherwise agreed in writing.
- Methods: We may accept cash, card, contactless, or invoicing partners (as available).
- Late/Unpaid amounts: We may charge late fees, interest, and/or suspend future service for unpaid balances.
4) Cancellations, Rescheduling & No‑Shows
- Please notify us as early as possible to cancel or reschedule.
- Deposits (if any) may be forfeited for missed appointments or late cancellations.
- Weather, supply issues, or safety considerations may require us to reschedule; we’ll communicate promptly.
5) Service Warranty & Limitations
We stand behind the quality of our workmanship. If you experience an issue with completed work, contact us within a reasonable time so we can assess and, at our discretion, rework the affected area. Normal wear, misuse, neglect, accidents, subsequent damage, environmental fallout, and third‑party alterations are excluded.
Paint correction & touch‑ups: Correction improves gloss and reduces visible defects but cannot always remove severe scratches or defects that have penetrated clear coat/base coat or primer. Spot paint or blending is intended to improve appearance, not to provide a factory‑new panel in all lighting conditions.
6) Vehicle Condition, Risk & Liability
- Pre‑existing issues: You acknowledge that vehicles may have prior damage, thin paint, repaints, aftermarket parts, or hidden defects that can limit results.
- Incidental risk: Standard detailing and correction involve tools and chemicals used according to industry practices; minimal risk remains even with proper care.
- Personal items: Please remove valuables. We are not responsible for loss of items left in vehicles unless caused by our gross negligence or willful misconduct.
7) Customer Responsibilities
- Provide accurate information, disclose prior bodywork, and alert us to sensitive surfaces or aftermarket equipment.
- Ensure safe access to the vehicle and, for mobile service, adequate space, lighting, and (if needed) power/water.
- Inspect work at delivery and raise concerns promptly so we can address them.
8) Photos, Reviews & Marketing
We may photograph vehicles before/after service to document condition and results. Unless you opt out in writing, you grant us a non‑exclusive, worldwide, royalty‑free license to use such images (with license plate and personally identifying details reasonably obscured) for portfolio, marketing, and educational purposes.
9) Third‑Party Products & Links
We may recommend coatings, cleaners, or accessories supplied by third parties. We are not responsible for third‑party websites, products, or services and provide no warranties for them.
10) Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FixaPro BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
12) Indemnification
You agree to indemnify and hold harmless FixaPro and our officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services, breach of these Terms, or violation of law or third‑party rights.
13) Dispute Resolution & Governing Law
- Good‑faith resolution: Contact us first; most issues can be resolved informally.
- Governing law & venue: These Terms are governed by the laws of the state in which the primary FixaPro location providing your Services is based, without regard to conflicts of laws. Courts of that venue shall have exclusive jurisdiction.
- Class Action Waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding to the extent permitted by law.
14) Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here with a new “Last Updated” date. Continued use of the Services after changes means you accept the revised Terms.
